Hi Thomas,
We are concerned on a couple of matters.
1) You do not give any indication on your website nor in your plans
that the plans are not adequate to successfully replicate the device. But on March 10 you
said to me, "we cannot tell anyone exactly how to operate the unit." (ref)
2) You do not give any indication on your website as to the
difficulty of getting the device to run after it is built per your plans. But on March 15
you told RetroRocket59, "Think of it as threading a needle from across a room, it is a
difficult task but it can be done." (ref)
In our view, these are very serious misrepresentations [...].
We (pes_mxlo individuals) commenced this project with the
expectation -- based on statements on your site -- that this device would both be easy to build
and to operate.
[We think you should] modify your website to honestly portray that
(1) the plans are not complete, and (2) the device is not easy to get to run.
[It would also be nice if you would relay to us (comprised largely
of many paying customers)] the final information required to get the unit to operate
[...]. Follow through with your word.

(Sterling's preface regarding message below from Thomas Jean of MXLO)
Thomas is in serious denial. With all the talent we have seen
directed to the replication of device, to no avail at a working unit, even with drawing
extensively from MXLO input, Thomas is still claiming they do not misrepresent the (1) adequacy
and (2) ease of the plans as posted and sold on their site, and duplicated on ours. This
lack of integrity does not speak well of them.
Regarding the NDA offer below mentioned by Thomas, I was advised
against entering into such by the PES board and our outside counsel. It would create too
much of a potential liability and conflict where our stated mission is to open source our
technology. Why should thy require an NDA when their website promise is to assist people to
build a working unit based on their easy plans? No NDA is mentioned there; not even a hint.

Your subject title was an inappropriate choice of words. We have nothing to come clean about and have offered every bit of support we possibly could for your group, this includes going extra steps in supporting those who were not in our customer base, but stated they were members of your PES forum. Everything in the plans is adequate to replicate the device other then the way to start the unit, which we support our customer base to overcome, and which you now know as the adjustment of stator around rotor. We are not further obligated to disclose to you or your group exactly how the device works outside of what is already disclosed. Unless your group is full of 11-year-old elementary students, I am certain they have the knowledge, understanding and belief of how and why a magnetic motor works otherwise they would not be pursuing the matter. I personally have expressed many times that not everyone will build and run this unit, nor will everyone who builds a Bowman, Calloway, Meg, or one of the many other magnetic motors be successful. It takes patience, which you seem to continue overlooking. As for your statement of our misrepresentations, and a violation of trust, please consider the following. I gave you the opportunity for a full disclosure of the device, and it's workings, but you chose to make this public to your group, which then complicated the terms. If you feel trust is an issue, then you must reexamine your choice. I suspect this was due to your anticipation to profit from the device instead of being bound by a non-disclosure, which by the way would have been a benefit to your group, if not to you. The purchaser of our material must agree that their purchase is "for educational purposes only" before placing an order, so nothing within our website needs to be changed for your satisfaction. A gift is placed before those who recognize and accept it. Those who do not can simply return it
to the store.
