1. SCOPE: This agreement governs the use of any and all of the information contained in these open-source archives.
2. DEFINITIONS:
A. Open Source Content includes, but is not limited to data, documents, plans, descriptions of information and samples, specifications, diagrams, photographs, videos, software, formulas, compilations, databases, or any other information contained in these open-source archives.
B. Use includes, but is not limited to accessing these open-source archives, copying, downloading, distributing, or translating, the information in these archives, or preparing derivative works therefrom.
3. ACCEPTANCE OF THIS AGREEMENT: By using the information contained in
these archives as defined in paragraph (2), you accept the terms and conditions
set forth in this agreement.
4. NO INTELLECTUAL PROPERTY RIGHTS IN OPEN-SOURCE CONTENT:
A. POLICY: It is the policy of Pure Energy Systems (PES) to publish in these archives only what the contributors of the open source content intend to be placed in the public domain.
B. Open source content is intended to be made available to the general public, without restriction or limitation, and therefore shall not be subject to copyright.
C. Open source content constitutes a disclosure, and will be interpreted by patent offices and courts around the world as a bar to patentability.
D. PES shall not be held liable by any party for making available on its website any open source content which it believed, in good faith, and in the exercise of reasonable judgment, that it was authorized to make available.
E. If you believe that material has been posted to the open-source archives in violation of patent, copyright, trademark, trade secret, or any other intellectual property laws, please contact PES immediately at <legal {at} pureenergysystems.com >, and present evidence that your intellectual property rights have been violated by said posting, in order that the content in question be immediately removed from the open-source archives.
5. USE OF INFORMATION FROM OPEN-SOURCE ARCHIVES:
A. You may copy, download, distribute, or translate the open-source content, in any medium, or prepare derivative works from the open-source content.
B. When referencing documents or other materials from the open-source content, you must cite to those sources in bibliographies, footnotes, or endnotes in accordance with generally accepted citation guidelines, such as those found in the Chicago Manual of Style.
C. You may charge a fee for the media and/or handling involved in creating a unique copy of the information for use offline or for providing any value-added service in connection with the information, including instructional support, but you may not charge a fee for the information itself or for providing exclusive access thereto.
6. WARRANTIES:
A. The information made available in these open-source archives is for educational purposes only, and is therefore presented “as is,” without express or implied warranties of any kind, including warranties of merchantability or fitness for a particular purpose.
B. Use of any open-source content from the PES open source archives, or any reliance upon any opinion, advice, statement, memorandum, or information made available to you via PES News, including any directions or instructions as to how to replicate or reproduce a device, is at your sole risk.
C. PES shall therefore not be held liable for any accident, injury, or ill effects that result from your use of or reliance upon the open source content, and shall not be required to pay damages of any kind, including any general special, incidental, or consequential damages flowing from such accident, injury, or ill effects.
D. PES represents, warrants and covenants that, to the best of its knowledge, no information of any kind made available to the general public through its open source archives:1. violates, plagiarizes, or infringes upon the rights of any third party, including copyright, trademark, trade secret, privacy or other personal or proprietary rights; or
2. contains libelous material; material posted in violation of the national security laws and regulations of the United States and other countries; or any other unlawful material.
7. GOVERNING LAW: This Agreement is governed by the laws of the United
States of America, and of the State of Nevada.
